TERMS & CONDITIONS

Nau-t-Cat RC Boats is a trading name of EXTRUD3D Pty Ltd (“EXTRUD3D”, “we”, “us”, “our” or “Nau-t-Cat”).

These Terms & Conditions apply to all purchases made through the Nau-t-Cat RC Boats website.

By placing an order, you acknowledge that you have read and accepted these Terms & Conditions.

1. Made-to-Order Products

All Nau-t-Cat boats are manufactured to order unless specifically stated otherwise.

Each boat is individually manufactured, assembled and prepared for its customer. Manufacturing may include 3D printing, machining, assembly, painting, electronics installation, testing and finishing.

Because our products are individually manufactured, minor variations in colour, finish, dimensions, fitment and appearance may occur.

2. Product Specifications

Product photographs, renders, videos and illustrations are intended to demonstrate the general appearance of our products.

The final product may differ slightly from photographs or renders as a result of manufacturing processes, material availability, component availability or ongoing engineering improvements.

Nau-t-Cat reserves the right to make reasonable technical or manufacturing changes where such changes do not materially alter the product ordered.

3. Customisation

Where offered, customers may customise aspects of their boat including colours, graphics, decals, names, electronics and other components.

Once a custom specification has been confirmed, changes may not be possible without affecting the production timeframe or price.

Customers who provide artwork, logos or other intellectual property for use on a boat are responsible for ensuring that they have the right to use that material.

4. Component Substitution

We endeavour to supply the components specified in the product listing.

If a particular component becomes unavailable, Nau-t-Cat may substitute it with a component of equal or greater functional specification where reasonably necessary.

Where a substitution would materially alter the agreed specification, we will endeavour to communicate this to the customer.

5. Performance

RC boats are performance products and their performance is affected by numerous variables.

These include battery selection, battery voltage, battery capacity, propeller selection, water conditions, wind, boat loading, trim, motor and ESC temperatures, radio settings, maintenance and operator technique.

Nau-t-Cat therefore does not guarantee a specific top speed, acceleration, runtime, turning radius, handling characteristic or other performance result unless expressly agreed in writing.

6. Customer Modifications

Customers may modify their boats at their own discretion.

However, modifications to motors, ESCs, batteries, propellers, steering systems or other components can significantly affect the operation of a boat.

Nau-t-Cat is not responsible for damage resulting from unauthorised modifications, incorrect assembly or inappropriate component selection, except where applicable law provides otherwise.

7. Intellectual Property

All Nau-t-Cat designs, CAD files, hull designs, graphics, photographs, renders, logos, product descriptions and other original materials remain the property of Nau-t-Cat and/or EXTRUD3D Pty Ltd or their respective licensors.

Purchasing a physical boat does not transfer ownership of the underlying CAD files, designs, manufacturing processes or other intellectual property.

Our designs may not be reproduced, manufactured, commercially exploited or distributed without written permission.

8. Build Photography and Content

Nau-t-Cat reserves the right to photograph and/or video record boats during manufacture, testing and completion.

This may include the hull, paintwork, graphics, decals, electronics, mechanical components and other aspects of the build.

Nau-t-Cat may use such content for legitimate business and promotional purposes, including its website, social media, advertising, product demonstrations and marketing material.

We will take reasonable steps to avoid unnecessarily publishing private customer information.

9. Prices

Prices displayed on the website are subject to change.

The price applicable to an order is the price displayed at the time the order is placed, subject to correction of obvious errors.

10. Payment

An order is considered confirmed once payment has been successfully received and the order has been accepted by Nau-t-Cat.

11. Limitation of Liability

To the maximum extent permitted by law, Nau-t-Cat and EXTRUD3D Pty Ltd will not be liable for indirect, incidental or consequential losses arising from the use of a product.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Nothing in these Terms & Conditions is intended to exclude any statutory right that cannot legally be excluded.
